Soledad Deck & Fence provides residential deck building, fence installation, pergola construction, and related outdoor structure services to homeowners in Soledad, CA and surrounding areas. The Site is used to provide information about those services and to allow potential customers to submit inquiries.
We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
Estimates provided by Soledad Deck & Fence are based on information available at the time of the visit and the scope of work as understood at that point. All estimates are presented in writing before any work begins.
Prices are subject to change if the scope of work changes after an estimate is issued, if unforeseen site conditions are discovered during construction, or if material costs change significantly between estimate and project start. We will notify you of any such changes and obtain your written approval before proceeding with additional work or cost.
An estimate is not a binding contract until a written agreement is signed by both parties.
Project start dates are scheduled based on our current workload, permit timelines, and material availability. We will provide you with an estimated start date at the time of contract signing. Start dates are subject to change due to weather, permit delays, or other conditions outside our control.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellations after materials have been ordered or work has begun may be subject to charges for materials purchased and work performed up to the time of cancellation. Specific cancellation terms will be stated in the written project agreement.
Payment terms are outlined in the written project agreement signed before work begins. Typical arrangements include a deposit due at contract signing, progress payments at specified milestones, and a final payment due upon completion.
Failure to make payments as agreed may result in work being paused or stopped until payment is received. Overdue balances may be subject to interest charges or collection action as permitted under California law.
Under California law, a contractor may not request or accept a deposit exceeding 10 percent of the contract price or $1,000, whichever is less, before work begins, unless a performance and payment bond is provided. All payment terms will comply with applicable California contractor licensing law.
Soledad Deck & Fence will obtain all required building permits for covered projects as part of our service. Permit fees are included in the project estimate unless otherwise noted. The homeowner is responsible for disclosing any known easements, HOA restrictions, underground utilities, or other property conditions that may affect the project before work begins.
Any warranty on workmanship or materials will be described in the written project agreement. Manufacturer warranties on materials are passed through to the customer to the extent permitted by the manufacturer.
Workmanship warranties do not cover damage caused by misuse, neglect, natural disasters, acts of vandalism, or modifications made by anyone other than Soledad Deck & Fence after project completion.
The Site and its content are provided "as is" without warranties of any kind, express or implied, including but not limited to accuracy, completeness, or fitness for a particular purpose.
To the fullest extent permitted by applicable law, Soledad Deck & Fence will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services or the Site. Our total liability to you for any claim arising out of or related to a project will not exceed the amount you paid us for that specific project.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be limited under California law.
All content on the Site - including text, images, logos, and design - is owned by or licensed to Soledad Deck & Fence and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission.
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You may not use the Site to transmit any unlawful, harmful, or objectionable content, or to attempt to gain unauthorized access to any part of the Site or its systems.
If a dispute arises out of or relates to these Terms or any services provided by Soledad Deck & Fence, the parties agree to attempt to resolve it informally first by contacting us directly. If informal resolution is unsuccessful, disputes will be submitted to mediation before either party pursues formal legal action, except where urgent injunctive relief is necessary to prevent irreparable harm.
Nothing in this section limits any rights you may have under California contractor licensing law or other applicable consumer protection statutes.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action relating to these Terms or our services will be brought in the appropriate courts located in California.
We may update these Terms from time to time. When we do, we will post the updated Terms on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
